Constitutional justice in Kyrgyz Republic

Summary

The Constitutional Court of Kyrgyz Republic was established in 1990, when Kyrgyzstan was still in the composition of the USSR. The new Constitution of 1993 has fixed, that the Constitutional Court is the supreme body of judicial power protecting the Constitution, the constitutional structure‚ the citizens' constitutional rights and freedoms.

The institute of the constitutional control in Kyrgyz Republic, the principles of the activity of the Constitutional Court, its composition‚the powers, a range of the subjects entitled to address are in detail represented in the article.

Among the subjects, having the right to address to the Constitutional Court, the citizens have a special place‚ they are given the right to direct submission to the Constitutional Court on questions immediately concerning their constitutional rights.

The Constitutional Court of Kyrgyz Republic has a great confidence of its citizens. The number of decisions adopted by the submission of citizens‚ which apply for the restoration of their violated rights (almost two third from the adopted decisions) testify about it.

Annulling the legal force of unconstitutional norms of the law‚ the Constitutional Court clears a legal field from the unconstitutional laws and the laws, accepted before the adoption of the Constitution, which are not in conformity with constitutional norms, asserting the constitutional principles of justice and providing the supremacy of the Constitution.

The Constitutional Court as much as possible provides guarantees for the protection of human and citizens' rights and freedoms and the recognized international standards, that promoting for the formation of democratic and lawful state, which is worthy to enter to the world society by carrying out its powers in accordance with the Constitution.
