The role of Constitutional justice
in formation of rule of law state
(experience of the Constitutional Court of the Republic of Moldova)

Summary

The report is dedicated to the formation and development of the ideas of constitutionalism and rule of law state in the Republic of Moldova‚ in particular‚ the role of constitutional justice for formation of rule of law state. The author generalizes six-year experience of activity of the Constitutional Court of Moldova and notes its achievements and shortcomings. The author proves the efficiency of the constitutional justice, independent from the practical expediency and the political sights and mentions the appropriate factors ensuring the independence of justice.

In the end the author draws conclusions on a number of measures capable to create optimum conditions for the realization of the constitutional justice, offering, in particular:

- to create the mechanism for providing the prompt execution of the Constitutional Court decisions;

- to provide a complete and precise normative-legal regulation of the organization and the activity of the Constitutional Court;

- to provide a high professional training for judges and collaborators of the Staff of the Constitutional Court;

- to create a scientific, material and technical base for the maintenance of a due level of the Constitutional Court activity.

The specified measures, from the point of view of the author, will assist the Constitutional Court to become more effective and authoritative.
