INTERNATIONAL COOPERATION

Fields of Action

From the very first year of its establishment, the Constitutional Court of the Republic of Armenia has undertaken an active and participatory approach to the international cooperation and promotion of dialogue and implementation of mutually beneficial projects with the partner courts, supranational courts and international organizations.

The international cooperation policy of the Constitutional Court is aimed at ensuring the engagement of the Republic of Armenia in the international organizations and processes in the field of constitutional justice, strengthening cooperation with the constitutional courts of friendly and partner states, presenting the positions of the Constitutional Court of Armenia in the international scene and raising efficiency of protecting the interests of Armenia.

Within the framework of its international cooperation policy, the Constitutional Court hosts conferences and workshops, which are aimed at exchanging the views and the best practices on contemporary issues in the field of constitutional justice. Moreover, the Justices and the personnel of the Constitutional Court frequently participate in the local and international thematic events and conferences dedicated to the constitutional law.

The Constitutional Court is actively engaged in the activities of several international and regional professional organizations. The Staff of the Constitutional Court seeks also an opportunity to facilitate discussion on an international level by providing English and Russians translations of its doctrinal and/or high public interest decisions, as well as the press releases, which are which are available in the relevant sections of the official website of the Constitutional Court.

Membership in the International Organizations and Associations

Venice Commission of the Council of Europe

Within the framework of its international activities, in 1996 the Constitutional Court established working relations with the European Commission for Democracy through Law of the Council of Europe (the Venice Commission) and to this day effectively participates in the activities of its Joint Council on Constitutional Justice. In the course of the cooperation with the CoE Venice Commission, the Constitutional Court submits the English and French précis of its decisions to be presented in the CODICES database, while the Liaison Officers of the Constitutional Court participate in the activities implemented within the auspices of the Commission.

Conference of European Constitutional Courts

Since 2000 the Constitutional Court has been obtained membership of the Conference of European Constitutional Courts and is a full member of the family of European constitutional courts. The Conference of European Constitutional Courts, which was established in Dubrovnik in 1972, brings together representatives of 40 European states’ national constitutional or equivalent courts conducting a constitutional review. The organization promotes the exchange of information among its members on issues relating to the methods and practice of constitutional review and provides a forum for the participants to share opinions on institutional, structural and practical problems in the areas of public law and constitutional jurisdiction.

Eurasian Association of Constitutional Review Bodies

On 24 October 1997, upon the proposal of the Constitutional Court of Armenia, the international organization “Conference of Constitutional Control Organs of Countries of New Democracy” was established in the post-Soviet space, which is currently transformed into the Eurasian Association of Constitutional Review Bodies. The activities of the Association are aimed at promoting generally accepted constitutional values, maintaining a permanent dialogue and sharing experience on the issues of ensuring the supremacy of constitution. The organs exercising constitutional review on the national level in Armenia, Russia, Kazakhstan, Belarus, Azerbaijan, Kyrgyzstan, Mongolia, Tajikistan and Uzbekistan are the members of the Association. The Secretariat of the Association publishes the international bulletin "Constitutional Justice", which editorial board is composed of representatives of all member courts of the Association.

World Conference on Constitutional Justice

While attaching a specific importance to the consistent dialogue between courts at the global level, since 24 September 2011 the Constitutional Court of Armenia has become a member of the World Conference on Constitutional Justice. This international organization brings together 117 constitutional courts, constitutional councils and supreme courts from Africa, America, Asia, Australia/Oceania and Europe. The Organization promotes the administration of constitutional justice, including the exercise of constitutional review, as well as it contributes to the protection of human rights and strengthening of the rule of law.

ECHR SUPERIOR COURTS NETWORK

While attaching the special importance to the effective cooperation with the supranational courts, since 2016 the Constitutional Court has become a member of the Superior Courts Network initiated by the ECHR. The activities on this platform were launched in 2015 as a result of the Brussels Conference Declaration adopted by the member states of the Council of Europe within the framework of the Belgian Chairmanship at the Committee of Ministers of the Council of Europe. The overall aim of the SCN is to enrich dialogue and the effective implementation of the European Convention on Human Rights, as well as to promote the enhancement of relations between the national high courts and the ECHR. The SCN frequently hosts scientific and practical events and discussions, where the exchange of best European experience takes place.
