On December 6-7, 2013 Mr. Gagik Harutyunyan, the President of the RA Constitutional Court, participated in the 97th Plenary Session of the European Commission for Democracy through Law of the Council of Europe (the Venice Commission), during which there were also discussed matters related to the Republic of Armenia. Particularly, the draft of the RA Law “On Making Amendments and Additions to the Civil Code of the Republic of Armenia” was considered during the plenary session, in regard of the introduction of the institute of material compensation for moral damage to the Civil Code of the Republic of Armenia. Mr. Harutyunyan, while referring to the mentioned issue, informed the members of the Commission, that the RA Constitutional Court by its Decision DCC-1121 of November 5, 2013, recognized Article 17 Part 2 of the RA Civil Code as unconstitutional, so far as it did not consider moral damage as a kind of the damage and did not provide possibilities for compensation for moral damage. Mr. Harutyunyan also informed the Commission, that by the mentioned decision, the RA Constitutional Court stipulated October 1, 2014 as the deadline for the annulment of the disputed provision.

The agenda of the 97th Plenary Session of the Commission also included report regarding the recent constitutional developments in the Republic of Armenia. Mr. Harutyunyan informed the participants about the current stance of the RA constitutional reforms, the formation of the professional commission for the constitutional reforms, and about the working format and envisaged activities of that commission. Mr. Harutyunyan also informed the participants about the achieved agreement with the Venice Commission to create an expert group from the members of the Commission, which will provide expertise assistance to the process of development of the concept of the constitutional reforms of the Republic of Armenia, and accordingly will also contribute to the process of the implementation of the envisaged constitutional reforms.

On December 7, 2013, in accordance with the preliminary defined program, there were organized the elections of the President, Vice-Presidents, Members of the Bureau and Chairpersons and Vice-Chairpersons of the Sub-Commissions took place. By the decision of the Commission, Mr. Harutyunyan was elected for a two year term as the Member of the Bureau of the Venice Commission. Mr. Gianni Buquicchio was reelected as the President of the Commission.

The Venice Commission was created in 1990 as an advisory body of the Council of Europe on constitutional matters. Today, the Commission counts 59 member states including all the 47 member states of the Council of Europe and 12 other countries.

On November 27-29, G. Harutyunyan, President of the Constitutional Court of the Republic of Armenia participated in the work of the World Forum of Democracy. In the scope of the Forum, on November 28, Mr. Gagik Harutyunyan held working meetings with Mr. Gianni Buquicchio, President of the European Commission of the European Council “Democracy through Law”, Mr. Thomas Markert, Secretary of the Venice Commission, Ms. Simona Granata-Menghini, Deputy Secretary of the Venice Commission, Mr. Schnutz Dürr, Head of the Constitutional Justice Division. During the mentioned meetings Mr. Harutyunyan presented the current situation of the preparation of the constitutional reforms in the Republic of Armenia, the work of the constitutional professional commission, as well as discussed the main terms and guidelines of cooperation with the Venice Commission in the domain of the constitutional reforms. On November 29, Mr. G. Harutyunyan made a presentation for the participants of the session the Direct Democracy of the World Forum of Democracy and touched upon the current challenges of the effective implementation of the direct democracy and answered the questions of the participants of the discussion.

THE PRESIDENT OF THE RA CONSTITUTIONAL COURT LEFT FOR SAINT PETERSBURG

On November 7, 2013 the joint seminar organized by the RA Constitutional Court and the Constitutional Court of Austria resumed its activities.

On November 13-16, 2013 Mr. G. Harutyunyan, the President of the RA Constitutional Court, will participate in the international conference dedicated to the 20th anniversary of adoption of the Constitution of the Russian Federation, which will be convened in Saint Petersburg.

During the conference Mr. Harutyunyan will deliver report titled “Challenges of the Contemporary Constitutionalism”.

JOINT SEMINAR CONCLUDED ITS ACTIVITIES

On November 7, 2013 the joint seminar organized by the RA Constitutional Court and the Constitutional Court of Austria resumed its activities.

The joint topic of the second working session was “The Constitutional Court and its Control of Elections”. Mr. Helmut Hörtenhuber, the Justice of the Constitutional Court of Austria, and Mr. Felix Tokhyan, the Member of the RA Constitutional Court, made the respective reports on the discussed topic. The participants of the working session addressed many questions to both rapporteurs and as a result, there was conducted an active discussion.

The results of the seminar were summarized by Mr. G. Harutyunyan, the President of the RA Constitutional Court, and Mr. G. Holzinger, the President of the Constitutional Court of Austria. Both sides highly valued the activities of the seminar, which had become a new boost for the exchange of experience and deepening of cooperation. The materials of the seminar will be published in “Constitutional Justice” Bulletin.

In the afternoon the delegation of the Constitutional Court of Austria had a meeting with the members of the Scientific Council of the Law Faculty of Yerevan State University. Afterwards, the guests visited the Mesrop Mashtots Institute of Ancient Manuscripts and the Mother See of Holy Etchmiadzin.

JOINT SEMINAR OF THE CONSTITUTIONAL COURT OF THE REPUBLIC OF ARMENIA AND THE CONSTITUTIONAL COURT OF AUSTRIA

Upon the invitation of the RA Constitutional Court, the delegation of the Constitutional Court of Austria pays two day official visit (November 6-7, 2013) to Armenia. The delegation is headed by Dr. Gerhart Holzinger, the President of the Constitutional Court of Austria. In the composition of the delegation are included Mrs. Vice-President Brigitte Bierlein, Constitutional Court Justices Mr. Johannes Schnizer and Mr. Helmut Hörtenhuber, as well as Mrs. Maria Varga, the Secretary of the President and Mrs. Roswitha Schnabl, the Representative of the Protocol Department.

On November 6, 2013 the delegation of the Constitutional Court of Austria visited the RA Constitutional Court. The RA Constitutional Court Members and the Staff participated to the meeting.

Mr. G. Harutyunyan, the President of the RA Constitutional Court, expressed his thankfulness for accepting the invitation to pay visit to Armenia and introduced the participants to the guests.

In his turn, Mr. Holzinger presented the members of the delegation of the Constitutional Court of Austria and expressed his pleasure that this visit would help to deepen the cooperation between two courts. He gave a special importance to strengthening of bilateral relations and emphasized that the Constitutional Court of the Republic of Armenia had a notable contribution within the frames of general cooperation between the constitutional courts of the European states. As one of the good proofs of it is that on July 2013 in Armenia was convened an international conference in which participated almost all European constitutional courts.

The first working session of the joint seminar took place afterwards. Mr. G. Harutyunyan, the President of the RA Constitutional Court, (report title: “Modern Challenges of the Institute of Individual Constitutional Complaint”) and Mr. Johannes Schnizer, the Justice of the Constitutional Court of Austria, (report title: “Protection of the Right to a Fair Trial in the Judicial Practice”) made the respective reports during the working session.

The first working session was concluded with question-answering part and the guests were introduced to the building of the RA Constitutional Court and got acknowledged with its structure.

In the afternoon, the delegation of the Constitutional Court of Austria visited the Armenian Genocide Museum-Institute and the Memorial dedicated to the victims of the Armenian Genocide.

Mr. Holzinger made a note in the visitor’s book of the Museum on his personal and the Austrian Delegation’s behalf.

On November 7, 2013 the joint seminar will be resumed.

On October 24, 2013, on the birthday date of the RA People’s Artist Mr. SOS SARGSYAN, Mr. G. Harutyunyan, the President of the RA Constitutional Court, visited the Komitas Pantheon-Park and paid tribute to the memory of the prominent actor.

GUESTS FROM GERMANY

On October 23, 2013 the German delegation which was visiting the South Caucasian countries (Georgia, Armenia, and Azerbaijan) paid visit to the RA Constitutional Court and had a meeting with Mr. G. Harutyunyan, the President of the RA Constitutional Court. The delegation, which included professors, post-graduate students, students and one prosecutor, was headed by Mr. Gilbert Gornig, the Professor of the University of Marburg (Germany).

Upon the request of the guests, Mr. Harutyunyan presented the RA CC structure, functions, international relations, as well as replied to the guests’ questions.

In their turn the guests presented the aims of their visit and the history of the University of Marburg, which was established in 1527 and is considered to be one of the oldest universities in Germany.

75th ANNIVERSARY OF ACADEMICIAN VLADIK NERSISYANTS

Mr. Vladik Nersisyants was one of the well known specialist’s of law theory, history and philosophy, as well a prominent expert of the history of the political and legal doctrines. He visited the RA Constitutional Court on April 4, 2002, when Mr. Harutyunyan, the President of the RA Constitutional Court, invited the Moscow-based prominent academician to visit Yerevan. During the mentioned meeting at the RA Constitutional Court there was developed an interesting dialogue between the famous academician and the Members and the Staff of the RA Constitutional Court. On those days, by the initiative of Mr. G. Harutyunyan and by the translation of V. Nazaryan several books of the Academician were published in Armenian and the Armenian readers were already quite informed about the publications of the famous scientist.

On October 7, 2013, by the initiative of the Center of the RA Constitutional Law was organized workshop dedicated to the 75th anniversary of Mr. Vladik Nersisyants, the Academician of the Russian Academy of Sciences, the Doctor of Law, Professor. The workshop was convened at the “Hall after Shahamir and Hakob Shahamiryans” of the RA Constitutional Court. The workshop was titled “The Legal-Philosophic Heritage of Academician Nersisyants and the Issues of Development of the Contemporary Law”.

Professor G. Danielyan and Mr. S. Mavrin, the Vice President of the Constitutional Court of the Russian Federation, made reports on the discussed topic.

Mr. G. Harutyunyan, the President of the RA Constitutional Court, Mr. G. Ghazinyan, the Chairman of the RA Bar Association and Mr. A. Vagharshyan, the Head of the Chair of Theory of State and Law, expressed their approaches towards the person of Vladik Nersisyants and his big scientific heritage.

PRC DELEGATION IN ARMENIA

On September 21-23, 2013, upon the invitation of the RA Constitutional Court, the Delegation of the Legal Commission of the National People's Congress of the People's Republic of China, headed by Mr. Sun Baoshu, paid an official visit to Armenia.

On September 21, 2013, Mr. G. Harutyunyan, the President of the RA Constitutional Court, received the Delegation. The Delegation was accompanied by H.E. Mr. Tian Changchun, the Ambassador Extraordinary and Plenipotentiary of the People’s Republic of China to the Republic of Armenia.

The Chinese Delegation had meeting with the Members and the Staff of the RA Constitutional Court at the “Hall after Shahamir and Hakob Shahamiryans” of the RA Constitutional Court’s. Mr. G. Harutyunyan, the President of the RA Constitutional Court, introduced the guests to the participants of the meeting, as well as briefly presented the activities of the Constitutional Court of the Republic of Armenia.

The parties developed a constructive talk regarding the peculiarities of the legal systems of two states, the priority of the rule of law principle, and also touched upon the future prospect of developing tighter relations and cooperation between two institutions.

During September 21, 2013 the guests visited Matenadaran (The Mesrop Mashtots Institute of Ancient Manuscripts), and in the evening they, accompanied by the RA CC President, attended the reception dedicated to the Independence Day of the Republic of Armenia.

On September 22, 2013 the Chinese Delegation visited Mother See of Holy Etchmiadzin and Zvartnots historical-cultural complex. The guests also made a non-formal visit to the Lake Sevan.

On September 23, 2013 the Delegation had meeting with Mr. Hovik Abrahamyan, the President of the RA National Assembly, which was followed up by the meeting with the Standing Committee on State and Legal Affairs of the RA National Assembly.

Harutyunyan, the President of the RA Constitutional Court, received the participants of “the Pan-Armenian Conference of the Heads and Representatives of the Diaspora Organizations”, who were participating to the mentioned conference organized on September 19-21, 2013 in Yerevan within the frames of the events and activities entitled “Ahead of the 100th Anniversary of the Armenian Genocide”. During their visit to the RA Constitutional Court the participants were accompanied by Ms. H. Hakobyan, the RA Minister of Diaspora.

The guests got acquainted with the activities of the RA Constitutional Court. The President of the RA Constitutional Court replied to the questions presented by the guests.

THE RA CC PRESIDENT RECIEVED ARA SAHAKYAN

On August 28, 2013 Mr. G. Harutyunyan, the President of the RA Constitutional Court, received the newly appointed Ambassador Extraordinary and Plenipotentiary of the Republic of Armenia in the Republic of Kazakhstan Mr. Ara Sahakyan.

Mr. Harutyunyan congratulated the Ambassador on the occasion of his appointment and presented broad reference regarding the tight cooperation between the Constitutional of the Republic of Armenia and the Constitutional Council of the Republic of Kazakhstan, which has been mostly developed within the last years. Mr. Harutyunyan presented also the implemented and envisaged steps of cooperation within the scopes of international organizations, “Conference of the Constitutional Control Organs of the Countries of New Democracy”, as well emphasized the importance of their preservation and further development.

During the meeting parties also discussed the impact of the relationship developed between the RA Constitutional Court and the Constitutional Chamber of Kyrgyz Republic and prospect of their further development. It was suggested to the newly appointed Ambassador to focus also on these fields during his further activities.

Mr. Sahakyan expressed his thankfulness for the presented valuable information and in his turn also gave special importance to the further cooperation between two countries in this field.

AMBASSADOR THE PEOPLE’S REPUBLIC OF CHINA AT THE RA CONSTITUTIONAL COURT

On July 11, 2013 Mr. G Harutyunyan, the President of the RA Constitutional Court, received Mr. H.E. Mr. Tian Changchun, the Ambassador Extraordinary and Plenipotentiary of the People’s Republic of China to the Republic of Armenia.

The Ambassador highly valued the activities and big importance of the recently convened Yerevan Pan-European Conference.

Mr. Harutyunyan presented to the Ambassador several copies of the Volume “New Millennium Constitutionalism: Paradigms of Reality and Challenges”, which has been published in Yerevan.

The Ambassador officially presented to the President of the RA Constitutional Court the official note regarding the planned visit to Armenia of the Delegation of the Legal Commission of the National People's Congress of the People's Republic of China. In China this Commission implements the constitutional review.

In August 2012 the President of the RA Constitutional Court through the kind mediation of the Ambassador Extraordinary and Plenipotentiary of the People’s Republic of China to the Republic of Armenia send an invitation note to the mentioned Commission, inviting to pay a visit to Armenia and through this reply note the Chinese side accepted the invitation. The parties also discussed the dates of the visit of the Delegation to Yerevan. The visit will take place on September 19-23, 2013.

IMPORTANT PUBLICATION

The world legal literature has got new extremely valuable volume titled “New Millennium Constitutionalism: Paradigms of Reality and Challenges”, which publication has been initiated by Mr. Gagik Harutyunyan, the President of the RA Constitutional Court, the Doctor of Law, Professor. The volume has been published in Yerevan and counts 2000 copies.

This volume is also unique in the sense of the fact, that it includes the articles of the worldwide known constitutionalists, who have presented extremely urgent issues and analyses. The presentation of the Volume took place at the “Medieval Hall” of the National Gallery of Armenia on July 5, 2013. It was also the last day of activities of the Yerevan Pan-European Conference, convened within the frames of the RA Chairmanship at the Committee of Ministers of the Council of Europe, and more than 80 international participants of the Conference participated to the Volume’s presentation.

Mr. G. Harutyunyan emphasized the necessity of preparing of the Volume, presented the 23 co-authors from 15 countries, which are internationally known legal experts, and valued their big contribution. Mr. Harutyunyan stated that about 1000 copies of the publication will be provided to the libraries and legal centers of approximately 100 countries, which will contribute to finding the respective systematic solutions to the issues raised in the publication.

The co-authors of the volume, particularly Mr. András Sajó, the Judge of the European Court of Human Rights, Mr. Egidijus Kuris, the Former President of the Constitutional Court of the Republic of Lithuania, Mr. Peter Paczolay, the President of the Constitutional Court of Hungary, Professors Eivind Smith and Otto Luchterhandt, gave in their short speeches special importance to the publication of the Volume and to their cooperation with the Armenian Constitutional Court.

Mr. Tigran Sargsyan, the RA Prime Minister, Mr. Vigen Sargsyan, the Chief of the Office of the RA President, Ms. Hermine Naghdalyan, the Vice President of the RA National Assembly, Mr. Hrayr Tovmasyan, the RA Minister of Justice, Mr. Arman Mkrtumyan, the Chairman of the RA Cassation Court, the Members of the RA Constitutional Court, the other officials, lawyers and constitutionalists participated to the presentation.

YEREVAN PAN-EUROPEAN CONFERENCE CONCLUDED THE ACTIVITIES

On July 4, 2013 the Yerevan Pan-European Conference, which was convened within the frames of the Chairmanship of the Republic of Armenia at the Committee of Ministers of Council of Europe, resumed its activities.

This conference, with its important topic and the large involvement of international participants is called up to emphasize the importance of the issue of guaranteeing and protecting the human rights and this issue is also organically connected with the scopes of discretion of powers and is aimed to develop both the conceptual and law enforcement approaches. This conference was also highlighted with the participation of many international delegations. Thus, it is not surprising, that Mr. Dean Spielmann, the President of the European Court of Human Rights, also accepted the invitation of the RA Constitutional Court and participated to the activities of the Conference and was accompanied with Ms. Alvina Gyulumyan, the ECHR Judge, and Mr. Johan Callewaert, the Deputy Grand Chamber Registrar.

The importance of the Conference was also emphasized in the short press interview of Mr. G. Harutyunyan, the President of the RA Constitutional Court, when he particularly stated the following: “The aim of such conferences is also to define rightly the conceptual apparatus…By the end of the Conference there has been adopted resolution of the Pan-European importance, which will induce the European institutions to the adoption of the certain solutions. As for us it is important, that Armenia has initiated the discussion on this theme and Armenia has become one of the equal legal parties, one of the initiating parties, for finding solutions to the serious European issues and it will allow us right in our state as well to try to find certain constitutional and legislative solutions for advancing the guarantees of protection of human rights to the new level”.

The topic of today's first session was titled “Judicial Review of the Laws and Other Legal Acts by Independent Judicial Bodies: Experience of Different States in the Sphere of Enrooting Effective System of Constitutional Review and in the Field of Cooperation with Different Bodies of State Power”.

During the session several reports were made, particularly by Mr. András Sajó, the Expert of the Venice Commission, Mr. Petr Miklashevich, the President of the Constitutional Court of Belarus, Mr. Wojciech Hermeliński, the Member of the Constitutional Tribunal of Poland, Mr. Mikhail Kleandrov, the Judge of the Constitutional Court of the Russian Federation, Ms. Laurence Burgorgue-Larsen, the Vice President of the Constitutional Court of Andorra

An active discussion was conducted regarding the reports. After the break, the Conference resumed its activities with the discussion of the topic “Cooperation of Human Rights’ Defender with Different State and Local Self-Government Bodies in Ensuring the Effective Implementation of the Principle of Rule of Law”. Ms. Aurelia Grigoriu, the Parliamentary Advocate of the Republic of Moldova, presented report.

After the discussion of the reports, Mr. G. Harutyunyan, the President of the RA Constitutional Court, introduced to the attention of the participants the final resolution of the Conference. It was adopted by the consensus.

YEREVAN PAN-EUROPEAN CONFERENCE

Today, on July 3rd, 2013, has been launched the Yerevan Pan-European Conference, which is convened within the frames of the Chairmanship of the Republic of Armenia at the Committee of Ministers of Council of Europe. The activities of the Conference take place at the Session Hall of the National Assembly of the Republic of Armenia.
The organizers of the Conference are the RA National Assembly, the RA Constitutional Court, the European Court of Human Rights, the European Commission for Democracy through Law (the Venice Commission), the RA Ministry of Foreign Affairs and the RA Human Rights Defender.

The topic of the Conference is “THE EUROPEAN LEGAL STANDARDS OF RULE OF LAW AND THE SCOPE OF DISCRETION OF POWERS IN THE MEMBER-STATES OF THE COUNCIL OF EUROPE”.

Mr. Hovik Abrahamyan, the President of the RA National Assembly, and Mr. Edward Nalbandian, the RA Minister of Foreign Affairs, made the opening speeches.

Mr. Vigen Sargsyan, the Chief of the Office of the RA President, presented the welcome speech of Mr. Serzh Sargsyan, the President of the Republic of Armenia.

Mr. Dean Spielmann, the President of the European Court of Human Rights, and Mr. Gianni Buquicchio, the President of the European Commission for Democracy through Law (the Venice Commission), addressed to the participants of the Conference with the welcome speeches.

The topic of the first session of the Conference was “Principle of Rule of Law as Axiological Ground for the Social Behavior of the Authorities and the Individual in the Rule of Law State: Constitutional Guarantees in Different Countries”.

During the session several reports were made, particularly Mr. Gagik Harutyunyan, the President of the RA Constitutional Court, presented report titled “Position and Role of Rule of Law in Human and Citizen's Behavior”, Mr. Peter Paczolay, the President of the Constitutional Court of Hungary, presented report titled “Constitutional Reform in Hungary: European Commitment and National Sovereignty”, Ms. Alvina Gyulumyan, the Judge of the European Court of Human Rights presented report titled “Positive Obligations of States”, Mr. Mato Arlovic, the Judge of the Constitutional Court of Croatia presented report titled “Constitutional Court Activism and European Legal Standards”. The session was concluded by the presentation of Ms. Maria Jose Rangel de Mesquita, the Member of the Constitutional Court of Portugal.

An active discussion was conducted regarding the above mentioned reports.

The topic of the second session was “Principle of Rule of Law as Criteria of Determination of the Scope of the Discretion of the Legislative and Executive Powers: Experience of Different States”.

During this session again several reports were made, peculiarly Mr. Boris Velchev, the Member of the Constitutional Court of Bulgaria, presented report titled “The Bulgarian Electoral Legislation and the Standards of Legality of Elections Laid Down in the Code of Good Practice in Electoral Matters Adopted by the Venice Commission”, Mr. Oleh Serheichuk, the Judge of the Constitutional Court of Ukraine presented report titled “The Principle of Rule of Law as the Criteria of Determination of the Scope of the Legislative Discretion: Ukrainian Experience” and Mr. Ilyas Bahtybaev, the Member of the Constitutional Council of Kazakhstan, closed up the session with his report titled “Implementation of the Norms of International Law in the National Legislation of Kazakhstan”.

After the conduction of thematic discussion on the reports, the first day of the activities of the Yerevan Pan-European Conference was finished.

Tomorrow, on July 4th, 2013, the Conference will resume its activities, where it is envisaged to adopt the resolution of the Yerevan Pan-European Conference.

DEAN SPIELMANN AT THE RA CONSTITUTIONAL COURT

On July 2, 2013 Mr. G. Harutyunyan, the President of the RA Constitutional Court, received Mr. Dean Spielmann, the President of the European Court of Human Rights, accompanied by Ms. Alvina Gyulumyan, the ECHR Judge, and Mr. Johan Callewaert, the Deputy Grand Chamber Registrar. The ECHR delegation is in Armenia to participate to the activities of the Yerevan Pan-European Conference, convened within the frames of the RA Chairmanship at the Committee of Ministers of the Council of Europe.

Mr. G. Harutyunyan presented to the guests the building of the Court and introduced the Constitutional Court’s structure and activities. Already at the Constitutional Court’s reception hall, the parties had discussion regarding the topic of the forthcoming Conference, specially emphasizing the importance of the principle of “rule of law”, as axiological ground and constitutional guarantee of the social behavior of the authorities and the individual in the rule of law state.

VISIT OF THE MINISTER OF JUSTICE OF GEORGIA

On June 18, 2013 Mr. G.Harutyunyan, the President of the RA Constitutional Court received Ms. Tea Tsulukiani, the Minister of Justice of Georgia, who was paying official visit to the Republic of Armenia. The Minister was accompanied by Mr. Gocha Lordkipanidze, the Deputy Minister of Justice of Georgia, Mr. Tengiz Sarmanashvili, the Ambassador Extraordinary and Plenipotentiary of Georgia to the Republic of Armenia, and Ms. Mariam Mkiladze, the Head of the Public Relations Department of the Ministry of Justice of Georgia.

During the meeting the parties discussed issues related to the newly adopted legislation in Georgia, which is the result of the judicial-legal reforms and they had been also discussed within the frames of the Venice Commission. As it has been reported previously, on June 14-15, 2013 Mr. Harutyuanyan, as the Member of the Venice Commission, participated to the 95th Plenary Session of the Venice Commission, where among other 20 agenda items, were also been discussed issues related to the constitutional reforms in several states, including Georgia.

The parties also discussed several issues related to the constitutional reforms and to the possibilities of the further enlarging and deepening of the cooperation between the RA Constitutional Court and the Ministry of Justice of Georgia.

VISIT OF THE RA CC PRESIDENT

On June 14-15, 2013 Mr. G. Harutyunyan, the President of the RA Constitutional Court, participated to the Plenary Session of the European Commission for Democracy through Law of the Council of Europe (the Venice Commission) and to the Bureau Meeting of the World Conference on Constitutional Justice.

More than 20 agenda items were discussed during the 95th Plenary Session of the Venice Commission, particularly the issues related to the constitutional reforms in several states (Ukraine, Romania, Turkey, Monaco, Georgia, Bosnia and Herzegovina).

The President of the RA Constitutional Court presented to the Commission details regarding the preparatory activities of the upcoming Yerevan Pan-European Conference, which will take place on July 3-5, 2013.

IMPERATIVE OF RULE OF LAW

On June 5, 2013 the Center of the RA Constitutional Law and the Chair of Theory of State and Law of the Law Faculty of YSU held at the RA Constitutional Court’s “Hall after Shahamir and Hakob Shahamiryans” the seminar titled “The Position and Role of the Principle of Rule of Law in the Public Behavior of the Authorities”. The main speakers of the seminar were Mr. G. Harutyunyan, the RA CC President, and Mr. Artur Vagharshyan, the Head of the Chair of Theory of State and Law of the Law Faculty of YSU.

The President of the RA Constitutional Court was one the main initiators and supporters of the above mentioned seminar, taking into consideration the existing various interpretations of the principle of “rule of law”.

Mr. Harutyunyan first of all emphasized the necessity of convening the seminar, conditioning it with the several circumstances. Firstly, this year will be celebrated the 75th anniversary of our compatriot, prominent expert of legal science Mr. Vladik Nersisyants. He has been widely known expert not only within the frames of the Soviet Union, but also among the world legists. On October 2, 2013, which will be the birth date of the prominent legist, in Armenia will be launched separate conference dedicated to the approaches of Nersisyants concerning the philosophy of law and contemporary challenges.

Secondly, the Pan-European Conference which will take place on July 2-5, 2013, will also turn to the topic of today's seminar, emphasizing the international importance of the issue. The President of the European Court of Human Right and the President of the Venice Commission, chairmen of the constitutional and equivalent courts, ombudsmen, and parliamentary delegations of many states will attend this forum.

While turning to the topic of rule of law, Mr. Harutyunyan stated the international responsibility which has taken the Republic of Armenia: “Armenia is a member of the Council of Europe, it has ratified the Statute of the Council of Europe and according to its Article 3 “Every member of the Council of Europe must accept the princi¬ples of the rule of law.”

In his report the speaker presented in details the importance of the principle of “rule of law”, the problems which exist with the interpretation of the principle, as well as the legal content of the principle.

The second speaker Mr. A. Vagharsyan, the Head of the Chair of Theory of State and Law of the Law Faculty of YSU, turned in details to the philosophical-theoretical and legal content of the concept of “rule of law”, to its perception and problems of the implementation of the principle of “rule of law”.

On May 14, 2013 the Moscow Delegation, which was in Yerevan within the frames of the Conference “The Development of the Constitutional Order in Armenia and Russia”, visited the RA Constitutional Court.

The Members of the RA Constitutional Court Mr. V. Hovhannisyan, Mr. V. Poghosyan, Mr. F. Tokhyan, Mr. A. Khachatryan and the Head of the Staff of the RA Constitutional Court Mr. A. Hakobyan participated to the meeting. The Guest’s delegation was presented by S. Avagyan, M. Salikov, V. Nevinski, G. Davtyan, S. Sheverdyayev.

The guests were introduced to the activities of the RA Constitutional Court.

During the meeting the main topic of discussion was the activities which are aimed to the development of the constitutional justice in two countries.

THE RA CC PRESIDENT’S VISIT TO TAJIKISTAN

From May 13-14, 2013 Mr. Gagik Harutyunyan, the President of the RA Constitutional Court, will participate to the regional consultation, which will take place in Dushanbe, at the capital of the Republic of Tajikistan. Mr. Harutyunyan is invited to the consultation as the Chairman of “Conference of the Constitutional Control Organs of the Countries of New Democracy” and Member of the European Commission for Democracy through Law of the Council of Europe (Venice Commission).

During the regional consultation, which is convened by the Constitutional Court of the Republic of Tajikistan within the frames of the judicial-legal reform project, the President of the RA Constitutional Court will present expert opinion on the new draft of the constitutional law of the Republic of Tajikistan on “the Constitutional Court of the Republic of Tajikistan”.

Within the frames of the visit the Presidents of the Constitutional Courts of the Republic of Armenia and the Republic of Tajikistan will sign memorandum on the further cooperation between the constitutional courts of two states.

PROSECUTOR GENERAL OF THE ISLAMIC REPUBLIC OF IRAN AT THE CC

On April 30, 2013 the delegation led by Mr. Gholam-Hossein Mohseni-Eje'I, the Prosecutor General of the Islamic Republic of Iran, who arrived to Armenia on a working visit, visited the Constitutional Court of the Republic of Armenia.

While welcoming the guests, Mr. Gagik Harutyunyan, the President of the Constitutional Court of the Republic of Armenia, presented the activities of the Court. In his turn the Prosecutor General of the Islamic Republic of Iran presented the current judicial legal system of his state.

The parties also discussed several questions related to the further development of the cooperation between two states in the legal and judicial fields.

THE PRESIDENT OF THE CONSTITUTIONAL COUNCIL OF ALGERIA AT THE RA CC

On April 10, 2012 Mr. Tayeb Belaiz, the Special Representative of the President of the Republic of Algeria, the President of the Constitutional Council of the Republic of Algeria, who was in Armenia to participate to the inauguration ceremony of the newly elected RA President S. Sargsyan, visited the RA Constitutional Court.

Mr. Harutyunyan introduced to the guest the activities and international relations of the RA Constitutional Court.

The sides exchanged opinions regarding the further cooperation of two institutions in the sphere of constitutional justice, as well as regarding information exchange and the other matters of bilateral interaction.

Within the frames of the development of bilateral relations, Mr. Belaiz invited Mr. G. Harutyunyan to visit Algeria.

Several other questions related to the further cooperation were also raised.

THE DELEGATION OF THE CONSTITUTIONAL COURT OF THE REPUBLIC OF ARMENIA PAID OFFICIAL VISIT TO THE CONSTITUTIONAL COURT OF THE RUSSIAN FEDERATION

On April 2, 2013 within the frames of the official visit to Russia, the delegation of the Constitutional Court of the Republic of Armenia, including the President Mr. Gagik Harutyunyan, the Justice Mr. Ashot Khachatryan and Mr. Arushan Hakobyan, the Head of the Staff, had a meeting with the Judges of the Constitutional Court of the Russian Federation at the Senate Building in Saint-Petersburg.

The bilateral dialogue was hold in the round table format, dedicated to the contemporary problems of guaranteeing the rule of law and direct effect of the constitution in the activities of the Constitutional Courts of Armenia and Russia.

During the meeting Mr. Valery Zorkin, the President of the Constitutional Court of the Russian Federation, noted, that the tight and fruitful cooperation between the two courts had been established both on the bilateral, as well as on the multilateral levels, particularly within the frames of Conference of the Constitutional Control Organs of the Countries of New Democracy. For the outstanding service, Mr. Valery Zorkin was awarded with the Gold Medal of the Constitutional Court of the Republic of Armenia.

The President of the Constitutional Court of the Republic of Armenia introduced to his Russian colleagues the organization, authorities and decisions of the supreme body of the constitutional control of Armenia. He also shared with his perception of the problems of implementation of the principles of constitutionalism within the frames of formation of the rule of law state and proceeding to the market relations. The issues, touched upon by Mr. Gagik Harutyunyan, raised big interest of the Judges of the Constitutional Court of the Russian Federation and became topic of active discussion.

The visit of the Delegation continued with the attendance of the North-West Institute of the Russian Presidential Academy of National Economy and Public Administration, where the ceremony of conferment of the “Honorary Doctor’s Degree” to Mr. Gagik Harutyunyan and his public lecture on the topic “The Actual Face of the Transformational Constitutionalism” took place.

The direct bilateral relations between the Constitutional Court of the Republic of Armenia and the Russian Federation were established on 1997, when the delegation of the Constitutional Court of the Republic of Armenia led by the President G. Harutyunyan made its first official visit to Moscow.

ELECTION PROCCESSES ON SPOTLIGHT

On January 23, 2013 Mr. G. Harutyunyan, the President of the RA Constitutional Court, had meeting with the delegation of the Observation Mission of the OSCE Office for Democratic Institutions and Human Rights (ODIHR) Election headed by Ms. Heidi Tagliavini.

By the request of the guests, Mr. Harutyunyan gave clarifications related to the judicial protection of the electoral right implemented by the CC, as well as talked about the existing electoral procedures and peculiarities.

Both parties highlighted the importance of the professionalism of the election commissions, the clear action of the institute of appeal, the public review of the electoral lists, and the people’s trust towards the election processes.

The parties raised also several questions related to the further cooperation.
