PRESIDENT OF THE CONSTITUTIONAL COURT HOSTED AMBASSADOR OF THE RUSSIAN FEDERATION TO THE REPUBLIC OF ARMENIA SERGEY KOPIRKIN

On 30 December 2020, President of the Constitutional Court Arman Dilanyan met with the Ambassador Extraordinary and Plenipotentiary of the Russian Federation to the Republic of Armenia Sergey Kopirkin.

The participants of the meeting exchanged views on the issues related to the cooperation between the Constitutional Courts of the Republic of Armenia and the Russian Federation. Both sides highlighted the cooperation within the framework of the Eurasian Association of Constitutional Review Bodies.

Ambassador Kopirkin thanked for the reception and wished success to Arman Dilanyan during his tenure.

IN 2020 CONSTITUTIONAL COURT SAVED 106 MILLION AMD

In 2020, the total savings of funds designated by the state budget of the Republic of Armenia for the needs of the Constitutional Court amounted to 106 million AMD, of which 63.2 million AMD was generated as a result of the annual financial summary. Earlier 43 million AMD was directed to the reserve fund of the Government of the Republic of Armenia, in connection with the situation in the country in September-October 2020.

Out of 63.2 million AMD generated as a result of the annual financial summary, about 52 million AMD was generated from the savings of funds designated to the Constitutional Court's salary and bonus funds, which were not used.

PRESIDENT OF THE CONSTITUTIONAL COURT HOSTED UN RESIDENT COORDINATOR IN ARMENIA SHOMBI SHARP

On 24 December 2020, President of the Constitutional Court Arman Dilanyan hosted UN Resident Coordinator, UNDP Resident Representative in Armenia Shombi Sharp.

Arman Dilanyan attached importance to the UN’s comprehensive support for the modernization of the public administration system and the reforms implemented in the judiciary and anti-corruption spheres of the Republic of Armenia.

Shombi Sharp appreciated the opportunity of the meeting and presented the projects implemented by the various UN agencies in Armenia. He expressed the hope for an enhanced cooperation between the UN Office in Yerevan and the Constitutional Court.

PRESIDENT OF THE CONSTITUTIONAL COURT ARMAN DILANYAN MET WITH CATHOLICOS OF ALL ARMENIANS

On 23 December 2020, President of the Constitutional Court Arman Dilanyan met with Catholicos of All Armenians in the Mother See of Holy Etchmiadzin.

During the meeting the current situation in the homeland was also touched upon.

The Catholicos of All Armenians stressed the role of the Constitutional Court in protecting the rule of law and justice in the country.

PRESIDENT OF THE CONSTITUTIONAL COURT HOSTED THE AMBASSADOR OF THE EUROPEAN UNION TO ARMENIA

On 23 December 2020, President of the Constitutional CourtArman Dilanyan met with the Head of the European Union Delegation to the Republic of Armenia, EU Ambassador Andrea Wiktorin and Deputy Ambassador Jan Plešinger.

The participants of the meeting exchanged views on the issues related to the current Armenia-EU cooperation. Both sides underlined the importance of cooperation and dialogue in the field of judicial reforms.

The EU Ambassador wished success to the President of the Constitutional Court in his responsible and challenging office.

THE NEWLY ELECTED PRESIDENT OF THE CONSTITUTIONAL COURT MET ARMAN DILANYAN, WITH PRIME MINISTER NIKOL PASHINYAN AT THE OFFICE OF GOVERNMENT

The newly elected President of the Constitutional Court Arman Dilanyan met with Prime Minister Nikol Pashinyan at the premises of the Office of Government.

In the course of the meeting, a reference was made to to the proposed judiciary reforms, and the involvement of the Constitutional Court in this process within its powers was highlighted.

The Prime Minister congratulated Arman Dilanyan on his election to a position of high responsibility and wished him success in ensuring the supremacy and direct effect of the Constitution in the legal system of the Republic of Armenia, in the implemention of its mission and ensuring the normal functioning of the High Court.

CONSTITUTIONAL COURT RECEIVED THE APPLICATION IN RESPECT TO TERMINATION OF POWERS OF GAGIK TSARUKYAN'S MANDATE

On 25 November 2020 at 18:27, the Constitutional Court received via "Mulberry" electronic system the application of the Council of the National Assembly of the Republic of Armenia in respect to the termination of the deputy powers of the Head of the "Prosperous Armenia" Faction of the National Assembly of the Republic of Armenia Gagik Tsarukyan .

The conclusion of 26 October 2020 of the Corruption Prevention Commission and the adjunct documents are indicated as the factual ground for the given application.

The application was submitted to the Constitutional Court on 26 November 2020, at 09:49. As of now, the compliance of the application and attached documents with the requirements prescribed under Articles 24 and 25 of the Constitutional Law on “the Constitutional Court” is being checked.

The Constitutional Court will issue a separate statement with the elaboration in regard to the procedures for admission of the application, case proceedings and examination of the case.

ARMAN DILANYAN PARTICIPATED IN THE INTERNATIONAL CONFERENCE OF THE COURT OF THE EURASIAN ECONOMIC UNION

On 25 November 2020, President of the Constitutional Court Arman Dilanyan, delivered a video address to the participants of the third International Conference of the Court of the Eurasian Economic Union titled “New Challenges for EAEU Integration: Legal Dimension”.

In his address to the conference participants, the President of the Constitutional Court attached importance to the role of national judiciary and supranational courts in ensuring the respect for the principle of the rule of law, protection of citizens' rights and fundamental freedoms amid the universal challenges of 2020.

Moreover, the President of the Constitutional Court stressed the importance of improvement of the normative-legal frameworks in the EEU region, which will ensure the effective exercise of the rights and responsibilities of the citizens, contributing to the development of member states’ economies.

The President of the Constitutional Court stated, in particular, “In the given context, the Strategy for Developing Eurasian Economic Integration until 2025 is of special significance, and the processes and mechanisms reflected therein, will contribute to the increase of the efficiency of the EEU institutions, including the Court of the Eurasian Economic Union, as well as it will enhance the attractiveness of the Union, the improvement of legal mechanisms of its competitiveness, the effective protection of the rights of entrepreneurs, the increase of scientific and industrial potential.”

Due to the Coronavirus pandemic, this year’s edition of the Conference was held online.

JUDGES OF THE CONSTITUTIONAL COURT DID NOT RECEIVE SUPPLEMENTS IN SEPTEMBER AND OCTOBER

In September - October 2020, the judges of the Constitutional Court did not receive any supplements. The employees of the Constitutional Court did not receive any supplements for October.

This was conditioned by the financial optimization carried out in the Constitutional Court in regard to the decision "On declaring martial law in the Republic of Armenia" on September 27, 2020. At the same time, in October 2020, upon the directive of the President of the Constitutional Court Arman Dilanyan, 84 employees of the Court received a supplement equal to 30% of their salaries for the work performed during September․ The supplements were provided at the expense of the fund for the supplements envisaged by the budget (the directive did not not apply to the judges of the Constitutional Court).

In addition, during October-November, the heads of two divisions of the Staff of the Constitutional Court (on a one-time basis) received a bonus equivalent to one month's salary.

In this context, in the interview with "Haykakan Zhamanak" daily newspaper, President of the Constitutional Court Arman Dilanyan noted that taking into account the situation in the country, the Constitutional Court as a state body tries to balance its expenses as much as possible and return the saved funds to the State Budget.

SAMVEL ARAKELYAN IS APPOINTED AS CHIEF OF STAFF OF THE CONSTITUTIONAL COURT

On November 3, 2020, upon the directive of the President of the Constitutional Court Arman Dilanyan, Samvel Arakelyan was appointed to the position of Chief of Staff of the Constitutional Court.

From April 2006, Samvel Arakelyan served at the Staff of the Constitutional Court as a leading specialist, and from 2007 as a chief specialist. In October 2016, he was appointed to the position of the Head of the Legal Advisory Department at the Staff of the Constitutional Court.

He holds a Candidate Degree in Law.

He is married with two children.

CONSTITUTIONAL COURT HAS ALLOCATED 43 MILLION AMD SAVINGS TO THE RESERVE FUND OF THE GOVERNMENT OF THE REPUBLIC OF ARMENIA

In October 2020, the Constitutional Court transferred 34 million AMD to the Reserve Fund of the Government of the Republic of Armenia, which was accumulated as a result of the optimization of the not yet actually financed spending’s envisaged by the 2020 budget.

The Constitutional Court, furthermore, has expressed readiness to transfer additional saved financial means in the amount of 9 million AMD to the Reserve Fund.

The saved financial means were transferred to the Reserve Fund due to the decision of September 27 of the Government of the Republic of Armenia "On declaring martial law in the Republic of Armenia".

THE CONSTITUTIONAL COURT CUTS ITS ANNUAL SPENDING: CHIEF OF STAFF

In 2021, 683 million 877 thousand AMD will be allocated from the State Budget of the Republic of Armenia for the operations of the Constitutional Court, which is approximately 23 million AMD less than the approved budget for 2020.

“The budget application of the Constitutional Court for 2021 consists of two activities, one of which refers to the operation of the Constitutional Court and administration of constitutional justice. The second is the reserve fund of the Constitutional Court. The budget for the operation of the Constitutional Court is 683 million 877 thousand AMD", stated the newly appointed Chief of Staff of the Constitutional Court Samvel Arakelyan at the joint sitting of the Standing Committees on State and Legal Affairs and Financial-Credit and Budgetary Affairs of the National Assembly.

89.3% of the approved budget will be aimed at the payment of wages.

PRESIDENT OF THE CONSTITUTIONAL COURT ARMAN DILANYAN OFFERED CONDOLENCES TO PRESIDENT OF THE CONSTITUTIONAL COURT OF AUSTRIA

On 3 November 2020, President of the Constitutional Court Arman Dilanyan addressed a letter of condolence to the President of the Constitutional Court of Austria Christoph Grabenwarter.

Arman Dilanyan’s letter reads, in part, “Terrorism, fundamentalism, intolerance, and fanaticism recognize no state borders and they pose a serious threat to guaranteeing the rule of law and fundamental freedoms in our societies.”

While expressing words of support and solidarity to the friendly people of Austria, Arman Dilanyan has added that the Armenian nation has experienced and day by day continues to experience on its own skin all disastrous consequences of extremism.

PRESIDENT OF THE CONSTITUTIONAL COURT ARMAN DILANYAN OFFERED CONDOLENCES TO PRESIDENT OF THE CONSTITUTIONAL COUNCIL OF FRANCE

On 2 November 2020, President of the Constitutional Court Arman Dilanyan addressed a letter of condolence to the President of the French Constitutional Council Laurent Fabius in regard to the terrorist attacks in Paris, Lyon, and Nice.

Arman Dilanyan expressed support and solidarity to the fraternal people of France and offered his sincere condolences to the families of the victims and their friends.

Arman Dilanyan’s letter reads, in part, “Such terrorist acts are a serious challenge to the rule of law in Europe and sustained protection of the fundamental freedoms of citizens”.

PRESIDENT OF THE CONSTITUTIONAL COURT ARMAN DILANYAN ACCEPTED CONGRATULATORY LETTER FROM GIANNI BUQUICCHIO

On 30 October 2020, the newly elected President of the Constitutional Court Arman Dilanyan received a congratulatory letter from President of the European Commission for Democracy through Law (Venice Commission) of the Council of Europe Gianni Buquicchio.

In particular, the letter reads in part: “I would like to congratulate you on your new position as President of the Constitutional Court of Armenia. The Constitutional Court of Armenia and the Venice Commission have always had an excellent relationship and your Court participates in our Joint Council on Constitutional Justice.”

In his response letter, the President of the Constitutional Court Arman Dilanyan highly appreciated the role played by the Venice Commission of the Council of Europe in supporting the comprehensive reforms underway in Armenia, which seek to strengthen democratic institutions in Armenia.

At the sessions held on October 23 and 26, 2020 (presiding - A. Dilanyan, rapporteur - V. Grigoryan), the Constitutional Court considered the case on determining the compliance of the obligations enshrined in the Convention against the Recruitment, Use, Financing and Training of Mercenaries with the Constitution.

In this case, the Constitutional Court ruled that the obligations enshrined in this Convention are in compliance with the Constitution.

PRESIDENT OF THE CONSTITUTIONAL COURT OF THE REPUBLIC OF ARMENIA ARMAN DILANYAN RECEIVED CONGRATULATORY NOTE FROM THE PRESIDENT OF THE CONSTITUTIONAL COURT OF THE RUSSIAN FEDERATION

On the occasion of the assumption of the office - the President of the Constitutional Court of the Republic of Armenia Arman Dilanyan received a congratulatory note from the President of the Constitutional Court of the Russian Federation Valery Zorkin. The congratulatory message reads in part: “On behalf of my colleagues and myself, I cordially extend congratulations to you in respect to your election to the high office of the President of the Constitutional Court of the Republic of Armenia. I am hopeful that the well-established relations between our courts will further continue to develop in the spirit of effective cooperation”.

In his reply letter, the President of the Constitutional Court Arman Dilanyan expressed his thankfulness to his Russian counterpart for the congratulatory message and conveyed a hope that the long-standing cooperation between the courts would be consistently strengthened and would include the entire scope of legal cooperation.

ELECTION OF THE PRESIDENT OF THE CONSTITUTIONAL COURT

Within the given press release, the Staff of the Constitutional Court informs that on 12 October 2020, during the procedural session of the Constitutional Court of the Republic of Armenia – Justice Arman Dilanyan was elected to the position of the President of the Constitutional Court.

According to Article 166 Point 2 of the Constitution, the President of the Constitutional Court shall hold the office for a term of six years, without the right to be re-elected.

On 29 September, The ad interim President of the Constitutional Court Ashot Khachatryan, sent a letter to Kairat Mami, Chairman of the Constitutional Council of the Republic of Kazakhstan, Chairman of the Eurasian Association of Constitutional Review Bodies.

While addressing the acting chairperson of the abovementioned organization and briefing in details on the large-scale military activities unleashed by Azerbaijan on the entire Karabakh-Azerbaijani line of contact – A. Khachatryan drew the attention of the partners from the Eurasian region to the grave violations of fundamental principles of international humanitarian and human rights and suggested to undertake meaningful actions to halt Azerbaijani aggressive policy.

While briefing in details on the large-scale military activities unleashed by Azerbaijan on the entire Karabakh-Azerbaijani line of contact – A. Khachatryan underscored and urged the full members of the Conference of European Constitutional Courts to take meaningful actions to condemn and halt Azerbaijani aggressive policy which cannot be defined anyhow but war-crimes-oriented and existential threat towards the fundamental human rights of the civilian population of Armenia and Artsakh.

On 18 September 2020, the oath taking ceremony of Yervand Khundkaryan took place at the sitting of the National Assembly, and the latter assumed office forthwith after taking the oath in accordance with article 5 of the Constitutional Law of the Republic of Armenia on the Constitutional Court.

While introducing the newly elected judge to the Staff of the Constitutional Court, Ashot Khachatryan, The ad interim President of the Constitutional Court, wished him successful tenure at the Constitutional Court for the benefit of the rule of law and strengthening of the constitutionalism.

On 15 September 2020, upon the decision DNA-007-A of the National Assembly of the Republic of Armenia - Yervand Khundkaryan was elected as the Judge of the Constitutional Court.

INTRODUCTION OF THE NEWLY APPOINTED JUDGES AT THE CONSTITUTIONAL COURT

On 17 September 2020, Ashot Khachatryan, The ad interim President of the Constitutional Court, introduced the newly appointed judges Edgar Shatiryan and Arthur Vagharshyan, who had earlier taken the oath at the National Assembly of the Republic of Armenia, to the judges and the Staff of the Constitutional Court.

While welcoming the newly appointed judges and introducing them to the judges and the Staff of the Constitutional Court, A. Khachatryan wished them success in carrying out the high mission of a judge of the Constitutional Court and wished efficiency in joint work for the benefit of the supremacy of the Constitution and constitutional legitimacy in our country.

On 17 September 2020, the oath taking ceremony of E. Shatiryan and A. Vagharshyan took place at the sitting of the National Assembly, and the latter assumed office forthwith after taking the oath in accordance with Article 5 of the Constitutional Law of the Republic of Armenia on the Constitutional Court.

On 17 September 2020, at the fifth session of the National Assembly of the Republic of Armenia of the Seventh Convocation and upon the respective decisions - Yervand Khundkaryan, Arthur Vagharshyan and Edgar Shatiryan were elected as judges of the Constitutional Court.

ON THE 4TH CONGRESS OF THE ASIAN ASSOCIATION OF CONSTITUTIONAL COURTS AND EQUIVALENT INSTITUTIONS

On 27 August 2020, the 4th Congress of the Asian Association of Constitutional Courts and Equivalent Institutions, chaired by the Constitutional Council of the Republic of Kazakhstan, was held in the form of videoconference. Ashot Khachatryan, The ad interim President of the Constitutional Court of the Republic of Armenia participated in the work of the Congress. The Congress, entitled “Constitution of the 21st century: rule of law, the human being as the highest value, and the efficiency of the state”, was attended by the delegations of constitutional justice bodies from more than 30 countries of Asia and Europe.

In their speeches in respect to the agenda items, the participants of the Congress emphasized the role of the Constitutional Courts in the spheres of protection and promotion of human rights, the rule of law and democratic governance in times of the COVID-19 pandemic. While congratulating the colleagues from the Constitutional Council of the Republic of Kazakhstan on the 25th anniversary of the adoption of the Constitution – in his report A. Khachatryan particularly touched upon the matters related to the impact of the pandemic crisis on the constitutional doctrine of human rights.

H.E. Mr. Kassym-Jomart Tokayev, President of the Republic of Kazakhstan, addressed the participants of the Congress with a special video welcoming speech.

PLENARY SESSION OF THE EXECUTIVE BODY OF THE EURASIAN ASSOCIATION OF CONSTITUTIONAL REVIEW BODIES

On 26 August 2020 Ashot Khachatryan, The ad interim President of the Constitutional Court of the Republic of Armenia, participated in the remote plenary session of the Executive Body of the Eurasian Association of Constitutional Review Bodies. The representatives of all bodies exercising the constitutional review in 9 member party states to the Association attended the video meeting.

While welcoming the Chairmanship of the Constitutional Council of the Republic of Kazakhstan in the Association, Ashot Khachatryan expressed willingness of the Constitutional Court of the Republic of Armenia to steadily expand its engagement in the ongoing activities of the organization, as well as he emphasized the role of the Association in strengthening the regional partnership.

During the video conference, the participants thoroughly exchanged views on the implementation of the current programs and long-term goals of the Association. Upon the suggestion of the Secretariat of the Association, a decision was adopted to form a joint working group, which will develop a draft charter of the Association in the course of upcoming months and will present it for the approval of the participants of the next plenary session. The parties also discussed to the latest developments in respect to the 5th Congress of the World Conference on Constitutional Justice.

Mr. Hrayr Tovmasyan, President of the Constitutional Court congratulated Mr. Robert Spano on his election to the high office of President of the European Court of Human Rights, wished him success in his tenure and emphasized the close cooperation between the two institutions and its importance.

On March 5, 2020, Hrayr Tovmasyan, President of the Constitutional Court hosted the members of the delegation of the Organization for Security and Cooperation in Europe (OSCE) Office for Democratic Institutions and Human Rights (ODIHR).

The interlocutors touched upon the reforms in the judicial-legal sphere of Armenia and legislative processes and challenges. In response to the guests' questions, Hrayr Tovmasyan elaborated on the activities of the Constitutional Court, the recent developments concerning the Constitutional Court and other issues. Reference was also made to the process of amendments to the Constitution, constitutional regulations for the participation of the Constitutional Court in these relations, issues of ensuring the natural functioning of the Constitutional Court, etc.

MEETING WITH THE REPRESENTATIVES OF A NUMBER OF HEIs

On February 26, 2020, Alvina Gyulumyan, Vice-President of the Constitutional Court met with the representatives of the law departments of a number of universities.

Issues related to the organization of the Student Scientific Work Competition announced by the Constitutional Court on February 6, 2020 were discussed during the meeting. Alvina Gyulumyan presented the main purpose of the competition, noting that it is a good opportunity for the law students, Master's and PhD students to increase their interest in constitutional law, constitutional justice and human rights issues. She also noted that the results of the competition will be summed up and the award ceremony will be held on July 5, 2020, on the 25th anniversary of the Constitution. On the basis of the propositions of the participants, certain adjustments were made to the organization of the competition.

Alvina Gyulumyan, Vice-President of the Constitutional Court and Edgar Ghazaryan, Head of the Staff of the Constitutional Court answered the questions of the participants of the discussion. Special attention was also paid to the issues of possible cooperation between the Constitutional Court and different universities, and Alvina Gyulumyan expressed the readiness of the Constitutional Court to provide possible assistance to the universities.

INTERNATIONAL CONFERENCE IN MOLDOVA

From 19-20 February, Araik Tunyan, Judge of the Constitutional Court, participated in the International Conference on “Constitutional Justice and Public Response when the Decisions of the Constitutional Court do not Coincide with the Opinion of the Majority of the Public” organized on the 25th Anniversary of the Constitutional Court of the Republic of Moldova.

The Conference was attended by high-ranking representatives of the political and judicial spheres of the Republic of Moldova, as well as representatives and participants from the academic courts of the 14 partner countries of Russia, Ukraine, Belarus, Kazakhstan, the Baltic and Eastern Europe. Igor Dodon, President of the Republic of Moldova, Vladimir Turcan, President of the Constitutional Court, as well as Gianni Buquicchio, President of the Venice Commission welcomed the Conference participants.

Within the framework of the Conference, the newly elected President of the Constitutional Court of Moldova Mr. Vladimir Turcan also initiated courtesy meetings with the heads of foreign delegations. During a private conversation between Judge Araik Tunyan and Mr. Turcan, issues of further cooperation between the Constitutional Courts of Armenia and Moldova were discussed, as well as details of the participation of the delegation of the Constitutional Court of Moldova in the forthcoming international conference to be organized by the RA Constitutional Court.

PROFESSIONAL DISCUSSION IN THE CONSTITUTIONAL COURT

On February 19, 2020, a professional discussion on the “Interpretation of the Constitution” was organized within the framework of “Legal approximation towards European standards in the South Caucasus” project implemented by the Constitutional Court and the German International Cooperation.

Hrayr Tovmasyan, President of the Constitutional Court, Alvina Gyulumyan, Vice-President of the Constitutional Court, judges of the Constitutional Court, assistants of judges, staff of the Constitutional Court and representatives of the “Legal approximation towards European standards in the South Caucasus” project participated in the discussion. Hrayr Tovmasyan, President of the Constitutional Court, Doctor of Law welcomed the guests from Germany who travelled to attend this event, as well as the participants of the discussion. Hrayr Tovmasyan also highlighted more than two decades of effective cooperation with the German International Cooperation, highly appreciating the positive results and benefits. He further noted that the submitted topic was highly relevant, and the outcome of the discussion might be fruitful for the future activities. The keynote speaker Dr. Christian Hillgruber, Professor of the Chair of Law at the University of Bonn addressed the participants. During the discussion Dr. Otto Luchterhandt, Professor at the University of Hamburg, made comments on the discussed issues.

The speakers answered the questions of the participants followed by an exchange of views.

On February 6, 2020, Hrayr Tovmasyan, President of the Constitutional Court, organized an official reception for celebration of the 24th anniversary of the Constitutional Court. The reception was attended by CC judges and the staff of the court. After the State Anthem of the Republic of Armenia, Hrayr Tovmasyan, President of the Constitutional Court, delivered a speech.

In his speech, the President of the Constitutional Court congratulated the judges and the staff of the court on the 24th anniversary of the establishment of the Court and underlined the role played by the Court in the history of the Third Republic of Armenia, its past and current challenges, and expressed gratitude to the judges and former president in the administration of constitutional justice and the maintenance of the constitutional order, as well as the entire staff of the court for their efforts in the establishment and smooth operation of the activity of the court.

During the festive reception, the judges of the Constitutional Court and court staff had the opportunity to exchange congratulations and best wishes with each other.

VISIT OF THE VICE-PRESIDENT OF THE CONSTITUTIONAL COURT TO STRASBOURG

On January 31, 2020, at the invitation of Mr. Linos-Alexandre Sicilianos, President of the European Court of Human Rights, Mrs. Alvina Gyulumyan, Vice-President of the Constitutional Court participated in the official opening of the judicial year of the ECHR, in particular, in the seminar dedicated to the 70th anniversary of the European Convention on Human Rights and a solemn session of the ECHR.

The event was attended by eminent figures from the highest courts, national and local authorities and various international tribunals, as well as academic lawyers of the member states of the European Union and Council of Europe. During the solemn hearing, Mr. Linos-Alexandre Sicilianos, President of the European Court of Human Rights and Chief Justice Mr. Frank Clarke, President of the Supreme Court of Ireland, addressed the representatives.

MEETING WITH ANN M. LUSIN, PROFESSOR OF THE UIC JOHN MARSHALL LAW SCHOOL

Today, on January 22, 2020, H. Tovmasyan, President of the Constitutional Court met with Ann M. Lusin, Professor of the UIC John Marshall Law School - a prominent constitutional law expert who participated in elaboration of the draft of the 1970 Constitution of Illinois.

Prof. Lusin has arrived in Armenia on the occasion of the Central Asia Regional Moot Court Competition on the Right to Environmental Protection organized by the Stetson and Artsakh State Universities in Stepanakert.

The means to increase the effectiveness of cooperation with Diaspora lawyers and Armenian legal institutions were discussed with Prof. Lusin, the former President of the Armenian Bar Association of the United States of America who now is actively engaged in the rule of law state and law development programs in Armenia.

The meeting was also attended by A. Gyulumyan, Vice President of the Constitutional Court and T. Samuelian, former Dean of the American University of Armenia.

The staff of the Constitutional Court informs that taken as grounds the RA Human Rights Defender’s Letter No. 2-328 of December 23, 2019 and guided by part 1 of article 30 of the Constitutional Law on Constitutional Court, the Constitutional Court returned the application of the RA Human Rights Defender submitted to the Constitutional Court on March 27, 2019 on the determination of the issue of conformity of Parts 1-5.1 of article 416 of the RA Tax Code with the Constitution.

Today, on January 17, 2020, Alvina Gyulumyan was elected Vice-President of the Constitutional Court by a secret ballot at the procedural sitting of the Constitutional Court receiving the votes of 8 judges who participated in the sitting.

Today, on January 15, 2020, Hrayr Tovmasyan, President of the Constitutional Court of the Republic of Armenia had a video conversation with Gianni Buquicchio, President of the European Commission for Democracy through Law of the Council of Europe (Venice Commission) and other officials of the Commission.

During the conversation, the parties discussed in detail the events that unfolded around the Constitutional Court after the statement of October 29, 2019 made by Gianni Buquicchio and the adoption of the Constitutional Law “On Amendments to the Constitutional Law on the Constitutional Court”, which provides for a “mechanism for early retirement”.
