TWO-DAY SEMINAR-DISCUSSION AT THE CONSTITUTIONAL COURT WITH THE PARTICIPATION OF THE PROFESSOR OF LEIPZIG UNIVERSITY

On November 14-15, a seminar-discussion was held at the Constitutional Court, which was conducted by Dr. Christoph Degenhart, Professor at the University of Leipzig, Judge of the Constitutional Court of Saxony.

The topics of the seminar were as follows: “The constitutional complaint and its peculiarities in the context of the Constitution of the Republic of Armenia”, “The constitutional right to freedom of speech and expression, and its restrictions in the practice of the Constitutional Court of Germany”. As a specialist in state and administrative law, Mr. Degenhart introduced the right to freedom of expression in the Basic Law of Germany and the European Convention on Human Rights and noted the crucial importance of this right from the perspective of the development of a democratic society.

He presented the content of this right, forms of manifestation and peculiarities of the restrictions. He answered the questions of the judges of the Constitutional Court on the individual constitutional complaint prescribed in the amended Constitution, drawing parallels between the RA Constitutional Court and the Constitutional Court of Germany regarding the procedure and preconditions for acceptance of the complaint. In conclusion, Hrayr Tovmasyan, President of the RA Constitutional Court thanked the Professor for the informative two-day discussion, highlighting such meetings from the perspective of replenishment of knowledge and exchange of experience.

Meanwhile, the research of Professor Degenhart, devoted in particular to control systems, is highly respected.

The Professor is well acquainted with the Constitution of Armenia, since in 2015 he visited Armenia and advised the working group on constitutional reforms.

The seminar-discussion at the Constitutional Court was organized jointly with the “Advice on Legal and Judicial Reform in the South Caucasus” (GIZ) Program.

HRAYR TOVMASYAN, PRESIDENT OF THE CONSTITUTIONAL COURT MET WITH THE PRESIDENT OF THE CONSTITUTIONAL COURT OF MONGOLIA

Within the framework of the International Conference on “The New Millennium Constitutionalism”, Hrayr Tovmasyan, President of the RA Constitutional Court had a meeting with Mr. Odbayar Dorj, Chairman of the Constitutional Court of Mongolia, who arrived in Armenia on a working visit.

During the meeting, the parties exchanged views on international cooperation in the field of constitutional justice, as well as touched upon the role of the Constitutional Courts in strengthening of the democratic systems of the two countries.

At the request of the Mongolian party, Hrayr Tovmasyan, President of the Constitutional Court presented the functions and working methodology of the Constitutional Court in Armenia. Both parties emphasized the importance of the further dialogue and cooperation.

VISIT TO TSITSERNAKABERD

On November 2, within the framework of the International Conference on “The New Millennium Constitutionalism”, foreign high-ranking officials visited the Tsitsernakaberd Memorial Complex and laid flowers at the eternal fire, and paid tribute to the memory of the victims of the Armenian Genocide, as well as visited the Armenian Genocide Museum-Institute and learnt about the history and exhibits of that period.

Within the framework of the International Conference on "The New Millennium Constitutionalism", Hrayr Tovmasyan, President of the RA Constitutional Court met with Gianni Buquicchio, Chairman of the Venice Commission of the Council of Europe. The prospects of expanding and deepening the cooperation between the RA Constitutional Court and the Venice Commission, as well as a number of issues related to recent events in Armenia were discussed. The parties highlighted the importance of the ongoing processes in Armenia to be in accordance with the procedures prescribed by the Constitution.

Mr. Tovmasyan thanked the Venice Commission for the assistance in the development of legal reforms and, in particular, drafting the constitutional amendments. With respect to the RA Constitution, Mr. Buquicchio noted that it is one of the best constitutions in the European region. The parties underlined the importance of cooperation and expressed hope that the good traditions formed between the RA Constitutional Court and the Venice Commission will become more intensive.

Mr. Tovmasyan underscored his readiness to organize annual conferences jointly with the Venice Commission. Mr. Buquicchio emphasized that the Venice Commission will always be ready to provide legal assistance in the processes in Armenia.

SOLUTION OF LEGAL AND POLITICAL SITUATION SHOULD BE SOUGHT IN THE CONSTITUTION

“Despite the fact that constitutionalism as the materialization of the modern legal state has long been rooted in the developed democratic states and is being rooted in countries that took the path of democracy and the rule of law, including the Republic of Armenia, the main issue of rooting constitutionalism remains to be more than actual," said the President of the Constitutional Court at the International Conference on “The New Millennium Constitutionalism”. Hrayr Tovmasyan, highlighting the existence of similar professional and practical exchange platforms between Armenian and foreign partners, noted that he anticipates open and sincere discussions that will reveal the challenges in different countries as well as outline the possible ways to overcome them.

According to Mr. Tovmasyan, the constitutionalism is, first of all, the implementation of the constitutional value system which requires proper legal and political culture, broad public consensus on constitutional fundamental values, culture of consistent application of rights, effective procedures for ensuring the rule of law, viable state institutions and civil society institutions, as well as the public imperative and the requirement to fulfill unconditionally the commandments of the Constitution. Touching upon the title of the Conference, the President of the Constitutional Court noted that in the new millennium, the so-called fraudulent constitutionalism or imitation of constitutionalism challenge the constitutionalism. It is no less dangerous than the lack of constitutionalism. Therefore, in any State, any legal and political solution must be sought in the constitution; other route is fraught with legal uncertainty with all its possible consequences.

The International Conference on “The New Millennium Constitutionalism” is ongoing in the Constitutional Court on November 1-2. The goal of the Conference is to reveal the challenges in ensuring the constitutionalism in the 21st century and to discuss the mechanisms of ensuring the constitutionalism. The topics discussed are as follows: current challenges to justice and constitution, particularly, effective justice monitoring, judicial power in crisis situations, further strengthening of democracy through the rule of law, etc. Foreign high-ranking guests, amongst them the Chairman of the Venice Commission of the Council of Europe, the Chairman of the Constitutional Court of Mongolia, the Vice President of the Constitutional Court of Bosnia and Herzegovina and other high-ranking officials, law scholars, participate in the Conference. Tomorrow the Conference starts at 9:00 am, the fourth plenary session will be chaired by Ms. Ivana Hrdlickova, President of the UN Special Tribunal for Lebanon.

The International Conference on “The New Millennium Constitutionalism” will be held at the Constitutional Court on 1-2 November, at 09:30.

The goal of the Conference is to reveal the main issues and mechanisms of ensuring the constitutionalism in the 21st century.

The Conference will be attended by the Chairman of the Venice Commission, the Chairman of the Constitutional Court of Mongolia, the Vice President of the Constitutional Court of Bosnia and Herzegovina, judges of constitutional and supreme courts, the representative of OSCE/ODIHR, judges of different international tribunals of the UN, advocates, and other high-ranking foreign officials.

ARMAN DILANYAN IS ELECTED JUDGE OF THE CONSTITUTIONAL COURT

On 13 September 2018 Arman Dilanyan was elected Judge of the Constitutional Court by the Decision DNA-016-A of the RA National Assembly.

 

ARMAN EDWARD DILANYAN

Was born in 1974 in the village of Getapnya, Ararat Marz.

1996 - graduated from Faculty of Law of YSU.

2004 - PhD in International Public Law. PhD thesis topic: "International Courts and Issues of Peaceful Settlement of Interstate Disputes".

From 21.08.1996 worked at the Constitutional Court of the Republic of Armenia as the First Category Specialist of the Secretariat of the Staff, Assistant to the Vice-President and Head of the Division of Analysis of Individual Applications of the Legal Advisory Service (Department).

29.09.2012 - 26.04.2013 - Head of the Legal Advisory Service (Department) of the Staff of the Constitutional Court of the Republic of Armenia.

From 03.04.2006 to present - teaches at Armenian-Russian (Slavonic) University ("International Law", "International Justice").

From 03.04.2006 till February 2013 - Head of the Chair of International and European Law at the Law Faculty of Armenian-Russian (Slavonic) University.

On 12.12.2013, by the decree of the President of the Republic of Armenia, was appointed Judge of the RA Administrative Court. Since 2015 - teaches at the RA Attorney School ("Representation in Administrative Litigation", "Representation in Administrative Proceedings").

On 28.04.2017 was elected a member of the Council of the Association of Judges of the Republic of Armenia by the General Assembly of the Union of Judges of the Republic of Armenia. Member of the editorial board of the “Judicial Power” scientific-methodical journal.

Author of a number of scientific articles.

Married with two children.

WORKING VISIT OF THE DELEGATION OF THE CONSTITUTIONAL COURT OF THE REPUBLIC OF ARMENIA TO ASTANA

On August 27-30 the delegation of the Constitutional Court of the Republic of Armenia led by H.Tovmasyan, the President of the Constitutional Court paid a working visit to Astana, the capital of the Republic of Kazakhstan, during which he participated in the International Conference "A Constitution: the embodiment of the values of the rule of law, civil society and the modern state" dedicated to the Day of the Constitution of the Republic of Kazakhstan.

The conference was attended by the delegations of constitutional courts and other bodies exercising constitutional control of more than 30 countries, as well as representatives of the UN, the Council of Europe, the European Court of Human Rights and several other international organizations.

On August 28, 2018, the regular session of the the member-courts of the “Conference of the Constitutional Control Organs of the Countries of New Democracy” took place, during which a number of issues related to the activities of the Organization were discussed, in particular, the format of its participation in the 5th Congress of the World Conference of Constitutional Justice was set up, a new Internet webpage was presented. The participants of the meeting alsodiscussed the issue of the adoption of the Statute and the flag of the Organization and an agreement was reached to publish the Bulletin “Constitutional Justice” in electronic form twice a year.

On August 29, the President of the Republic of Kazakhstan, Nursultan Nazarbayev received the heads of the delegations participating in the International Conference, including H. Tovmasyan, the head of the delegation of the Constitutional Court of the Republic of Armenia.

PREPARATORY MEETING OF THE CONGRESS OF THE CONFERENCE OF EUROPEAN CONSTITUTIONAL COURTS

On 12-14 June 2018 the preparatory meeting of the upcoming Congress of the Conference of European Constitutional Courts took place in Prague, during which the host country, the Constitutional Court of the Czech Republic formally assumed the chairmanship of the above-mentioned pan-European organization till 2021. The preparatory meeting was attended by the delegations of various institutions implementing constitutional justice from 35 European states. The delegation of the Constitutional Court of Armenia was headed by Ms. Arevik Petrosyan, Judge of the Constitutional Court of the Republic Armenia.

During the preparatory meeting, the participants discussed a wide range of issues related to deepening of the cooperation between institutions implementing constitutional justice and outlined the prospects for expanding dialogue in the legal field. At the end of the preparatory meeting, the participants adopted a number of decisions, in particular, it was decided that the upcoming conference of the Circle of Presidents of the Conference of European Constitutional Courts will be convened on 26-28 May 2020 in Prague. The theme of the Congress is "Human Rights and Fundamental Freedoms: the Relationship of International, Transnational and National Catalogues in the 21st Century."

In parallel, on June 14, in the framework of the preparatory meeting of the Conference of European Constitutional Courts, the international conference dedicated to the 25th anniversary of the formation of the Constitutional Court of the Czech Republic was held. The head of the Armenian delegation, Ms. Arevik Petrosyan, Judge of the Constitutional Court made a main report. At the Conference, the Chairpersons of the Constitutional Courts of Germany, France, Spain, Slovenia, and Moldova made presentations likewise. The results of the International Conference were summed up by Mr. Pavel Rychetský the President of the Constitutional Court of the Czech Republic.

For your information, the Constitutional Court of the Republic of Armenia has been a full member of the Conference of European Constitutional Courts since 2000.

WORKING MEETING WITHIN THE FRAMEWORK OF THE VIII SAINT PETERSBURG LEGAL FORUM

On May 16, within the framework of the VIII St. Petersburg Legal Forum, the regular session of the member-courts of the “Conference of the Constitutional Control Organs of the Countries of New Democracy” was held at the “Pompeii” Hall at the Constitutional Court of the Russian Federation, which was attended by the delegations of the Constitutional Courts of the Republic of Armenia, the Republic of Belarus, Mongolia, the Russian Federation, the Republic of Tajikistan, the Constitutional Council of the Republic of Kazakhstan and the Constitutional Chamber of the Supreme Court of the Kyrgyz Republic.

The agenda of the working session included the coordination of the further activities of the Conference, cooperation with other international institutions, as well as the issues related to the participation in the “Congress of the World Conference on Constitutional Justice,” which will be convened in Algeria in 2020.

During the session, the new official logo of the Organization was adopted: Themis holding the Constitution, with the background of the sun surrounded by the rays of wheat. The participants of the meeting adopted a decision to convene the next session of the Conference within the framework of the International Conference which will be held in Astana, capital of Kazakhstan in August 2018. It should be noted that since September 2017, the Constitutional Council of the Republic of Kazakhstan has assumed the chairmanship at the “Conference of the Constitutional Control Organs of the Countries of New Democracy.”

CC DELEGATION PARTICIPATES IN SAINT PETERSBURG LEGAL FORUM

On May 15, the EIGHTH SAINT PETERSBURG LEGAL FORUM launched its activities within the framework of which on 15 May the Constitutional Court of the Russian Federation convened the international conference "Constitution in the Era of Global Change and Constitutional Surveillance” dedicated to the 25th anniversary of the adoption of the Constitution of the Russian Federation. The representatives of constitutional courts and equivalent institutions of more than four dozen countries, representatives of the UN, Council of Europe, ECHR and a number of other international organizations participated in the conference. The delegation of the Constitutional Court of the Republic of Armenia is represented by Judge A. Tunyan and the Chief of the Staff V. Vardanyan.

On May 16, the plenary session of the “Conference of the Constitutional Control Organs of the Countries of New Democracy” will also be held, where the main tendencies and perspectives of the strengthening and further development of the given international organization will be discussed.

POWERS OF GAGIK HARUTYUNYAN, PRESIDENT OF RA CONSTITUTIONAL COURT ARE TERMINATED

On 12 March 2018 Ara Babloyan, RA NA Speaker signed a protocol, which terminated Gagik Harutyunyan's powers.

Taking into consideration the resignation of Gagik Harutyunyan, President of the Constitutional Court of the Republic of Armenia and guided by Article 147 (2) of the Constitutional Law of the Republic of Armenia, the term of office of Gagik Harutyunyan, President of the Constitutional Court of the Republic of Armenia is terminated from March 8.

 

HRAYR TOVMASYAN IS APPOINTED AS THE PRESIDENT OF RA CONSTITUTIONAL COURT

On 21 March 2018, Hrayr Tovmasyan was appointed as the President of the Constitutional Court of the Republic of Armenia by the decision of the RA National Assembly.

HRAYR VARDAN TOVMASYAN

Born on 8 July, 1970 in the village of Darakert in the Ararat Marz.
1977-1988 – Attended Darakert High School.
1988 - 1990 - Served in the Soviet Army. Currently Reserve Major.
1995 - Graduated from the Faculty of International Law of the “Gladzor” University of Management. Lawyer.
1996-1998 – Studied at the Department of State and Legal Studies of the Institute of Philosophy and Law of the National Academy of Sciences (NAS) of the Republic of Armenia.
1996 - 1998 - Leading Specialist of the Legal Consulting Service of the Constitutional Court of the Republic of Armenia.
1998 - 1999 - Chief Specialist of the Legal Consulting Service of the Constitutional Court of the Republic of Armenia.
1999 - 2001 - Deputy Head of the Legal Consulting Service of the Constitutional Court of the Republic of Armenia.

PRESIDENT OF THE REPUBLIC OF ARMENIA VISITED THE CONSTITUTIONAL COURT

Today, President Serzh Sargsyan visited the Constitutional Court where he attended the ceremony of naming the Constitutional Court’s Session Hall after outstanding representatives of Armenian jurisprudence Shahamir and Hakob Shahamiryans.

Prior accompanied by incumbent Constitutional Court President Hrayr Tovmasyan and former CC President, Supreme Judicial Council Chairman Gagik Harutyunyan, the President of Armenia visited the Constitutional Court’s library, which is named after Gagik Harutyunyan and boasts rich legal, scientific, journalistic materials and professional manuals, intended not only for CC members and staff, but also for legal experts and students. The CC President noted that he was going to digitize the library and make it more accessible to the users thanks to new technologies.

During the ceremony of naming the CC Session Hall after Shamir and Hakob Shahamiryans, the President of Armenia congratulated those present on the event and wished the incumbent and former Presidents of the Constitutional Court every success in their most important and responsible mission aimed at enhancing the quality of justice in Armenia.

“Dear Colleagues,

The moment is really quite symbolic, first of all, in terms of the ongoing fundamental transformations in Armenia. Now, there is a rich study material for the future historians. And I hope their overall assessment will be positive. In turn, we should do our best to make it a reality.

Armenian legal thought has gone a long way to development. 200 years ago, Shahamir and Hakob Shahamiryans came up with innovative ideas and spoke about the importance of public institutions - the institutions that today serve as a basis for modern democracies.

I do believe that the moment when this hall is being named after the renowned Armenian legal thinkers will continue to be symbolic for the decision-makers, and, of course, very important for the people who will ever enter the hall.

I congratulate all of us for this good initiative. We appreciate the work done, and this is a very important circumstance. Taking the opportunity, I would like to thank Gagik Harutyunyan for his valuable contribution and congratulate him on the 70th anniversary of his birth.

In our times it is not easy to find a person who is hard-working and dedicated. Gagik Harutyunyan has always been where it was difficult and challenging. And he has always been consistent in dealing with different problems.

I think this was the main reason why the Supreme Judicial Council chose him as president of this important body. Thank you very much, Mr. Harutyunyan. I do not want to hold long speeches, because you will continue to hold the office in another important position, which is very unique in our country.

Together with your partners you must be able to secure the independence of judges and courts, and for that you should be the first to be independent. Otherwise, if you are not independent you will hardly be able to secure the independence of others.

Therefore, good words may be regarded as another circumstance and not an rewarding of success.

Dear Colleagues,

I would like to take this opportunity to congratulate Hrayr Tovmasyan on his election as President of the Constitutional Court. Mr. Tovmasyan, I wish you every success and good luck as you are taking over this extremely important steering wheel from Mr. Harutyunyan’s skillful hands. It puts a heavy burden on your shoulders.

Indeed, Hrair Tovmasyan is not a new person in our legal community. He is one of the authors of our constitutional reform. The concept of “architectural control” is used in construction. In this case, I think, Hrayr Tovmasyan will exercise this “architectural control” with thoughtfulness and care. As much as I know Hrayr Tovmasyan, the supremacy of the Constitution is a matter of principle and belief. I would like it to be continuous.

As I have said many times, we have a problem of improving the quality of public management. Its solution is not a problem for one person or a separate structure It is our task – those who have decided to participate in the difficult, but honorable work of state building.

We have the problem of public perception, the problem of correct transmission and presentation of our work to the public. There is still much to do here. I am convinced that the Constitutional Court, as well as the newly established Supreme Council will do their best to raise the quality of justice in Armenia and, not less important, to raise the level of public perception. I wish all of us good luck and a good start,” said President Serzh Sargsyan in his welcoming speech.

Hrayr Tovmasyan, President of the Constitutional Court thanked the President and all those present for attending the event and noted that complying with his colleagues’ advice, he made up his mind to start his activity in the Constitutional Court with a symbolic action, and finally he decided in favor of this emblematic event.

“Published as early as in 1783, “Trap of Vanity” by Shahamir and Hakob Shahamiryans was the first draft of a constitution in the world, written a few years earlier than the constitution of the United States, Poland and France appeared. It was also a program of Armenian national liberation movement and its theoretical justification.

It is noteworthy that as a matter of fact, “Trap of Vanity” substantiates the idea of parliamentary form of government, and it is symbolic that 230 years later we chose the path indicated by our compatriots that has become the basis for a democratic system in many countries. In just a few days we will switch over to the parliamentary system of governance.

The “Vorogayt Parats” is a precept to build the rule of law, and respect the supremacy of Constitution; in modern constitutional terms, it is the pledge for national progress, freedom and happiness.

Distinguished Mr. President,

Dear Guests,

Today’s gathering has another rationale, and it is difficult for me to say whether it is more or less important than the first one. Today, we named one of the halls of the Constitutional Court after the first President of the Constitutional Court, famous statesman Gagik Harutyunyan. Of course, this is a small piece of appreciation for Gagik Harutyunyan’s legacy, but at the same time, it has another meaning as it is a message to all future generations that the path to building statehood and ensuring constitutionalism to be embarked upon by the Constitutional Court as an institution and the State system in general, goes through appreciation, acknowledgement and continuity.

It was very important for me to start my job with this initiative symbolizing the continuity that we have to ensure for the Constitutional Court that used to be headed by Mr. Harutyunyan,” Constitutional Court Chairman Hrayr Tovmasyan said. Noting that today’s event comes on Gagik Harutyunyan’s last day in office, he handed over a small and symbolic souvenir to Gagik Harutyunyan on this occasion.

“It was difficult to choose a souvenir, which could symbolize the significance and Mr. Harutyunyan’s personality. And what has been chosen, Mr. Harutyunyan, in essence, is my idea instrumented by the hands of a sculptor, which symbolizes Gagik Harutyunyan’s motto, who is not simply standing on the Mother Earth but has ingrown in it, with the seeds in his hands, and the seeds symbolize a notable, professional, hardworking person, who loves his homeland; a person who creates a new system. Mr. Harutyunyan, I would like to pass this to you as a sign of gratitude and appreciation,” concluded Hrayr Tovmasyan.

The former President of the Constitutional Court, Supreme Judicial Council Chairman Gagik Harutyunyan expressed his thanks for the appreciation and praise and underlined that for him Shahamir and Hakob Shahamiryans are of a special significance in Armenian history.

“Many years ago, when we started publishing “Trap of Vanity” in modern Armenian, it was very difficult to find the portraits of Shahamir and Hakob Shahamiryans and “Trap of Vanity” itself is mostly based on archival materials. Our society, especially, the law society ascertained that “Trap of Vanity” was not created out of nothing and it became the summary of our people’s certain historical thinking.

I would like to inform that with the support of the Catholicos of All Armenians, we have initiated the publication of a two-volume collection, called “Constitutional culture in the pages of the ancient history of the nation first adopted Christianity as a state religion.” It is nearly three thousand pages and will be published at the end of this year. The book will be published in English next year, so that the worldwide readers could read and acknowledge it. The study will reveal the entire historical chain - from the Aratta Kingdom to the Shahamirians and thereafter. The book will be summed up in a summary article titled “Lessons of history and the motto of time.”

The only thing I can say is that success can be expected only where there is continuity, when a rock is placed on the other rock and drops of water grow into a lake or a river and is capable to ensure quality. I would recommend to all my colleagues and Constitutional Court members to take into consideration the following: what we have done so far is preparatory work.

You may remember that by 2005, we had examined the constitutionality of only ten laws over the past ten years, while today we are examining as many within just two months. Ten years and two months. However, the new constitutional amendments open completely new perspectives.

Tomorrow, the next day, from 9th April, when the new law comes into effect, new applicants may appear at the Constitutional Court and the workload and responsibility shall increase. I am convinced that the initial conditions we have been able to create will provide us with the opportunity to live up to such high responsibility.

Our task is the following: a lot has been done in terms of constitutional amendments, many have been communicating with the colleagues outside of the country, you have had meetings, and presentations at the conferences, and we have seen that there is no country today where when speaking of constitutional developments process achieved in Armenia is not praised. But everything may remain on the paper, if it is not implemented in real life. It ought not to be the situation when we have a constitution, but the constitutionality is incompatible and non-harmonic with it. We must really be able to implement the Constitution into life.

Mr. Tovmasyan, I have known you for a very long time and have witnessed your establishment. I cherish great hopes, I have great confidence that first of all, the internal atmosphere of friendship and partnership will help solve the problem of collaborative work, leading to even greater achievements. You know that I am with you; I will always be your supporter. We will do our best not only for the Constitutional Court, but also for the judicial system in the country.

The situation is that - yes, there is a dynamics, steps are made, but as an established system, we must start from the basics and be able to implement what we wanted during the constitutional reforms, which was initiated by the President of the Republic. It depends on each of us, and all our colleagues.

I am confident that our collaborative work will enable us to ensure quality and to say what we did and were doing in reality, that we were right, and with the suggestion or initiative that the President of the Republic made and implemented this constitutional model or this mechanism into life, is viable and can lead to many positive changes in the country. I wish you happiness and fruitful work. Together, we shall try to tackle the problems that are longing for the solution and should be solved the soonest possible,” said Gagik Harutyunyan.

THE HIGHEST AWARD OF THE NATIONAL ACADEMY OF SCIENCE OF THE REPUBLIC OF ARMENIA TO GAGIK HARUTYUNYAN

On March 16, the Presidium of the National Academy of Sciences hosted a commemoration dedicated to Gagik Harutyunyan, LL.D., Professor, Chairman of Supreme Judicial Council of the RA.

Radik Martirosyan, President of the National Academy of Sciences, briefly introduced Harutyunyan's path and highly appreciated his academic activities and great contribution in the development of the state, and congratulated him with the highest award of the Academy of Sciences.

For the outstanding contribution in the establishment of constitutional law and constitutional culture, promotion of the constitutional reform and development of jurisprudence in Armenia, Mr. Martirosyan awarded Gagik GARUSH HARUTYUNYAN with the gold medal - the highest award of the RA National Academy of Sciences.

Mr. Harutyunyan thanked for the high award and the vote of confidence.

The academicians, members of the Constitutional Court of the Republic of Armenia congratulated Mr. G. Harutyunyan and commended his academic activities and commitment in the state structures.

CHAIRMAN OF THE HIGHER COUNCIL WAS ELECTED

In accordance with Articles 84 and 166 of the RA Judicial Code within five days after election of the members of the Supreme Judicial Council, the members of the Supreme Judicial Council shall elect the Chairman of the Council from the composition of the members (5) elected by the National Assembly. Accordingly, the first session took place on March 5 at the Presidency Hall of the RA National Academy of Sciences.

The only issue on the agenda was the election of the Chairman of the Supreme Judicial Council. Gevorg Danielyan, Ruzan Hakobyan, Sergei Meghryan formed a counting commission. As the results of the secret ballot, Professor Gagik Harutyunyan was elected the Chairman of the Supreme Judicial Council.

At the first session, in a short notice, the newly elected Chairman G. Harutyunyan presented the Council's future plans.

THE NEW MEMBER OF THE RA CONSTITUTIONAL COURT

On March 5, G. Harutyunyan, President of the Constitutional Court of the Republic of Armenia presented Hrayr Tovmasyan, the newly appointed member of the Court to the members of the Court and the staff.

Mr. Harutyunyan described H. Tovmasyan as a professional lawyer and handed over the judge’s robe. Considering that he used to work as a leading specialist at the Constitutional Court 22 years ago, H. Tovmasyan mentioned that he has returned to his roots.

On February 7-9, the delegation led by Mr. G. Harutyunyan, President of the Constitutional Court of the Republic of Armenia, paid a working visit to Prague, the capital of the Czech Republic upon the invitation of Mr. Pavel Rychetský, President of the Constitutional Court of the Czech Republic.

Within the framework of the working visit the delegation, led by Mr. G. Harutyunyan, President of the Constitutional Court of the Republic of Armenia, held meetings with Mr. Pavel Rychetsky, President of the Constitutional Court of the Czech Republic, Ms. Milada Tomková, Vice-President of the Constitutional Court of the Czech Republic and Jiří Zemánek, Judge of the Constitutional Court of the Czech Republic.

During the meeting, the parties exchanged views on the topic of “Stability of Constitutions and Constitutional Amendments”, as well as touched upon the role of the Constitutional Courts in strengthening the sustainable democratic systems of the two countries.

At the request of the Czech party, G. Harutyunyan, President of the Constitutional Court of the Republic of Armenia presented in details the process of constitutional reforms in the Republic of Armenia.

Mr. Vladimir Hovhannisyan and Mrs. Arevik Petrosyan, Members of the Constitutional Court of the Republic of Armenia, also participated at the meeting.

Within the framework of the working visit the delegation of the Constitutional Court of the Republic of Armenia also held meetings at the Senate of the Parliament of the Czech Republic. In particular, issues related to the legal cooperation between the two countries and the role of the Constitutional Courts of Armenia and the Czech Republic in the direction of its development were discussed with Mr. Ivo Bárek, the Vice-President of the Senate.

On the occasion of jubilee, an event was held at the Constitutional Court with the participation of the staff of the Court, during which Mr. Harutyunyan, President of the Constitutional Court briefly touched upon the activities of the Constitutional Court over the past years, as well as highlighted further tasks of the Court in the context of constitutional amendments.

FAREWELL MEETING AT THE CONSTITUTIONAL COURT

On January 31, the members of the Constitutional Court and the staff bid farewell to CC member Kim Balayan, whose powers are suspended since February 1.

G. Harutyunyan, President of the RA Constitutional Court and the colleagues wished Mr. Balayan success in his future activities. Mr. Balayan thanked his colleagues for the harmonious cooperation in their joint work.
